πŸ‡³πŸ‡± Estate Settlement in the Netherlands

How Dutch Probate Liquidation & Asset Division Works

When someone with assets in the Netherlands passes away, their property, funds, and debts together form the estate. The inheritance rules under Dutch law determine how an estate is settled and divided β€” whether the heirs live in the Netherlands or abroad.

For heirs living outside the Netherlands, managing these steps from abroad can be difficult or impossible without local representation.

Below is a clear overview of how the process works, and who is responsible for what.

Step 1 β€” Valuing the Estate

All assets and liabilities must be identified and documented, including:

  • Real estate in the Netherlands (and abroad, if applicable)
  • Bank accounts and investments
  • Vehicles, valuables, and personal possessions
  • Debts, taxes, and final expenses (e.g., funeral costs)

This inventory determines what remains for the heirs. Some estates require reassessment due to inheritance disputes when paternity is confirmed later.

Why this matters:
Heirs abroad often struggle to obtain financial information or documentation from Dutch institutions, so local assistance can speed up this process.

Step 2 β€” Paying Debts & Taxes

Before heirs can receive anything:

  • Debts, loans, and outstanding bills must be settled
  • Legacies have to be paid out
  • Inheritance tax may be due in the Netherlands
  • Costs for estate management and professional services are paid from the estate

Only once financial obligations are handled can the estate be distributed.

Step 3 β€” Dividing the Estate

The remaining assets are distributed according to either:

  • A Dutch notarial Will, or
  • The statutory intestate rules (if no Will exists)
  • Heirs abroad often need help ensuring their share is properly calculated and transferred.

For example:

We recently assisted heirs in the UK and Germany with selling a Dutch property, settling the mortgage, and transferring the proceeds β€” all without them needing to travel.

The Role of the Dutch Court

Most Dutch estates are settled privately by heirs or their legal representative. However, the court becomes involved when:

Court procedures help protect heirs’ rights and ensure the estate is settled lawfully.

Example:

For instance, the court may need to intervene when an executor refuses to provide an inventory or when heirs abroad cannot access essential documents.

The Role of the Executor (Executeur)

If the deceased appointed an executor in their Will, that person:

  • Secures and manages estate assets
  • Pays taxes and debts from the estate
  • Distributes inheritances correctly
  • Signs legal paperwork on behalf of the deceased
  • Handles communications with Dutch banks and authorities

Executors carry legal responsibility and can be held accountable if errors are made.

If no executor was appointed, heirs may need to appoint an estate administrator or ask the court for assistance.

πŸ’‘ Why Professional Help Matters

Estate settlement becomes more complicated when:

  • Heirs live outside the Netherlands
  • Assets are located in multiple countries
  • There are disputes or delayed cooperation
  • Dutch inheritance tax applies
  • The executor is unresponsive or unfamiliar with Dutch law

A local specialist helps ensure the estate is settled efficiently and that you receive everything you are entitled to.

Nearly all Dutch estate-settlement tasks can be handled remotely. You do not need to travel to the Netherlands β€” we can take care of everything locally on your behalf as part of our Dutch inheritance legal services.
